State prosecutors in Utah have escalated their regulatory clampdown on prediction platforms by filing criminal charges against Kalshi and its top leadership. The action targets the company alongside chief executive officer Tarek Mansour and chief operating officer Luana Lopes Lara, accusing the exchange of violating state anti-gambling statutes.

In total, Utah has filed 14 criminal charges against Kalshi and the two executives. Among these counts are 12 specific allegations of illegally promoting online gambling, marking one of the sharpest legal confrontations yet between state authorities and the rapidly expanding prediction market sector.

An Escalating Multistate Legal Fight

The criminal filing represents a significant escalation in a broader, nationwide campaign targeting event contract exchanges such as Kalshi and Polymarket. Utah had already initiated civil proceedings against Kalshi, alleging that the platform was operating unlawfully within state borders. By bringing formal criminal charges against the corporate entity and its top executives, Utah has intensified the stakes beyond traditional administrative and civil enforcement.

Utah is not alone in challenging the legality of prediction markets. A growing coalition of state authorities has initiated legal actions against Kalshi, including regulators and prosecutors in New York, Nevada, New Mexico, Washington, and Connecticut, among others. State regulators have similarly turned their attention toward competing platforms, with both New York and Kentucky pursuing legal action against Polymarket.

Utah is also not the first jurisdiction to explore criminal proceedings against Kalshi. In March, Arizona became the first state to lodge criminal charges against the company. However, enforcement in that matter was interrupted after a federal judge intervened and blocked Arizona from proceeding with its case.

Federal Authority Versus State Oversight

The intensifying actions taken by individual states unfold against a contentious jurisdictional tug-of-war involving federal regulators. The Commodity Futures Trading Commission has actively pushed back against state-level regulation of prediction markets, asserting that federal law grants the agency exclusive jurisdiction over federally registered derivatives and event contract platforms.

This jurisdictional clash has resulted in a fractured and evolving landscape across the federal judiciary. States recently secured legal victories when two separate federal appeals courts ruled against bids by Kalshi and Polymarket to halt state-level oversight and enforcement.

Conversely, another appellate ruling favored federal exclusivity. In April, the 3rd U.S. Circuit Court of Appeals held that the Commodity Futures Trading Commission possesses exclusive authority to regulate prediction markets within New Jersey. That dispute remains unresolved at the highest level, as New Jersey recently petitioned the U.S. Supreme Court to take up the case and decide whether federal market oversight preempts state gaming enforcement.

Kalshi Vows Court Battle

Kalshi has firmly rejected Utah’s allegations, characterizing the criminal case as an unwarranted jurisdictional intrusion. In a statement addressing the charges, the company labeled the state action a crazy overreach.

The company also signaled that it intends to mount a vigorous legal defense aimed at invalidating the state charges. Kalshi stated that it looks forward to putting a stop to the prosecution in court, drawing a direct parallel to its previous success in securing federal judicial relief against the criminal proceedings initiated in Arizona.
